These terms govern your use of OneGaj. By accessing or using the platform, you agree to the terms below.
1. Acceptance of Terms
These Terms & Conditions ("Terms") form a binding agreement between you and Khandelwal Infraheights Private Limited, operating the OneGaj platform ("OneGaj", "we", "us", "our"), including this website and our mobile application (together, the "Platform"). By creating an account, browsing listings, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Platform.
2. Eligibility
The Platform is intended for use by individuals who are at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872. By registering, you confirm that you meet this requirement. OneGaj currently supports six account types — Buyer, Builder, Owner, Broker, Team Leader and Associate — each with role-specific features shown within the Platform. Builder accounts, and Associates registering under a Team Leader, are subject to review before gaining full access, as described in the next section.
3. User Accounts & Registration
Registration and sign-in use your mobile phone number verified by a one-time password (OTP) — OneGaj does not use passwords. You are responsible for keeping your phone number secure and for all activity under your account. Builder accounts are reviewed by our team before approval; until approved, a Builder's access is limited and their details are not shown publicly. A Team Leader with Associates assigned to them cannot delete their own account until those Associates are reassigned to another Team Leader, so an Associate's access is never silently broken. You may update your profile details — including your name, phone number, email, location, RERA number, company name (where applicable) and profile photo — from your account settings at any time, and you may permanently delete your account as described in our Privacy Policy.
4. Listings & Content Accuracy
Builders, Owners and Brokers are solely responsible for the accuracy, legality and completeness of the property listings and project details they submit to the Platform — including, for Builder project listings ('Schemes'), pricing, specifications, amenities, unit inventory, images and documents. OneGaj does not independently verify ownership, title, RERA registration, or construction status of any listed project or property, and makes no warranty as to the accuracy of listing content. Listings found to be misleading, duplicated, fraudulent, or non-compliant with applicable law (including the Real Estate (Regulation and Development) Act, 2016) may be rejected, suspended, or removed, with or without prior notice. OneGaj is a platform connecting Buyers, Owners, Builders and Brokers — we are not a party to, and do not guarantee the outcome of, any transaction, negotiation or agreement entered into between users.
5. Prohibited Conduct
You agree not to: (a) post false, misleading, or duplicate listings; (b) impersonate another person or misrepresent your role or affiliation; (c) use the Platform to send unsolicited commercial communications to other users; (d) attempt to bypass, probe, or interfere with the Platform's security, authentication (including OTP verification), or rate limits; (e) scrape, copy, or systematically extract listing or user data without our written permission; (f) upload content that infringes a third party's intellectual property, privacy, or other rights; or (g) use the Platform for any unlawful purpose. We may suspend or terminate accounts that violate this section, and reserve the right to report unlawful activity to the appropriate authorities.
6. Fees & Payments
Browsing, searching and enquiring about properties, and registering as a Buyer, Builder, Owner, or Broker, is currently free of charge. OneGaj does not currently process any payments, subscriptions, or commissions on the Platform, and is not a party to any payment, brokerage, or commission arrangement between users. We plan to introduce optional paid features for Brokers in the future, including subscription tiers, featured-listing placements, and commission tracking, through an integrated payment gateway. If and when these features launch, this section will be updated in advance with the applicable fees, billing terms, and refund policy, and your continued use of any paid feature will be subject to the updated Terms at that time.
7. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Khandelwal Infraheights Private Limited and its officers, employees and affiliates shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, including reliance on any listing, project, or user-submitted content, or any transaction or dispute between users. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law.
8. Governing Law
These Terms are governed by the laws of India. Subject to the Limitation of Liability section above, any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at [Insert registered office city], India.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will update the "Last updated" date below when we do, and for material changes we will take reasonable steps to notify registered users (for example, by email or an in-app notice) before the changes take effect. Continued use of the Platform after an update constitutes your acceptance of the revised Terms.
